These Terms of Service govern your access to and use of ShortGame, a service for creating, editing, playing, and publishing browser games with AI. By using ShortGame, you agree to these Terms and our Privacy Policy.
Who may use ShortGame
You must be able to form a binding agreement to use ShortGame. ShortGame is not intended for children under 13. If you are under the age of majority where you live, you may use ShortGame only with permission from a parent or legal guardian, and that person is responsible for your use.
Accounts
You may need to sign in with Google to create, save, edit, publish, or manage games. You are responsible for keeping your account secure and for all activity under your account. Tell us promptly if you believe your account has been compromised.
Creating games with AI
ShortGame uses AI and automated validation to generate playable game files and related assets from your prompts and follow-up instructions. AI output can be imperfect. You are responsible for reviewing, testing, and deciding whether a generated game is appropriate before you publish, share, rely on, or commercialize it.
AI-generated output may be similar to content generated for other users, may contain bugs, and may require additional review for intellectual property, safety, accessibility, advertising, platform, or legal compliance.
Your content and generated games
You keep your rights in prompts, instructions, assets, and other content you submit to ShortGame. To the extent permitted by law, you may use the games generated for you, subject to these Terms and any rights held by third parties.
You grant ShortGame a worldwide, non-exclusive license to host, store, process, reproduce, modify, display, publish, transmit, and create technical copies of your content and generated games as needed to operate, secure, improve, and support the Service. If you publish a game, you also authorize ShortGame to make that game and its public metadata available to other users and visitors.
Publishing and public games
When you publish or share a game, anyone with access to the public URL may play it. Public games may appear in ShortGame public play areas and may be indexed, cached, copied, or linked by third parties. Do not publish content you do not have the right to share.
We may remove, block, unpublish, or limit access to games that appear to violate these Terms, infringe rights, create security or safety risk, or expose the Service to legal or operational harm.
Credits, subscriptions, and billing
ShortGame may provide free credits and paid subscription plans. Credits are usage units for creating and editing games. Credits have no cash value, are not a bank account or stored-value instrument, and may not be transferred, sold, or redeemed for money.
Paid plans are billed through Stripe. Subscription plans renew automatically unless you cancel before the next billing period. Credits, prices, plan limits, and included features may change, but changes will not reduce credits already granted for the current paid billing period except where required for security, fraud prevention, legal compliance, or abuse response.
Unless required by law or stated in writing, fees are non-refundable and unused credits do not roll over beyond the terms shown for the plan or grant. If a payment fails, a subscription is canceled, or credits run out, game creation or editing may pause until credits are available.
Acceptable use
You may not use ShortGame to create, upload, publish, or distribute content or activity that:
- is illegal, harmful, abusive, harassing, threatening, hateful, or exploitative;
- infringes or misappropriates intellectual property, privacy, publicity, or other rights;
- contains malware, credential theft, phishing, deceptive flows, hidden tracking, or attempts to bypass browser or platform security;
- targets children with unsafe, manipulative, or age-inappropriate content;
- collects personal information from players without proper notice, consent, and legal basis;
- impersonates someone else or misrepresents affiliation, sponsorship, or endorsement;
- overloads, probes, scrapes, reverse engineers, or disrupts ShortGame or its infrastructure;
- uses automated accounts, bots, or abuse patterns to obtain credits, evade limits, or manipulate public play areas; or
- violates any law, regulation, third-party platform rule, or these Terms.
Third-party services
ShortGame relies on third-party services for authentication, payments, AI generation, asset generation, hosting, storage, databases, delivery, and security. Your use of those features may be subject to third-party terms and policies. ShortGame is not responsible for third-party services it does not control.
Intellectual property and feedback
ShortGame, including its product design, software, brand, logo, interfaces, and underlying technology, is owned by ShortGame or its licensors and is protected by intellectual property laws. You may not copy, modify, reverse engineer, or reuse the Service except as allowed by these Terms or applicable law.
If you send feedback, suggestions, or ideas, you grant ShortGame permission to use them without restriction or compensation.
Copyright and rights complaints
If you believe a game or asset on ShortGame infringes your rights, contact [email protected] with enough information for us to identify the content, understand the claimed right, and respond. We may remove or restrict content while reviewing a complaint.
Service changes and availability
ShortGame is a live product and may change over time. We may add, change, suspend, or remove features, models, plans, credits, limits, public game areas, and integrations. We try to keep ShortGame available, but we do not guarantee uninterrupted, error-free, or permanent access to any project, version, preview, or public game.
Termination
You may stop using ShortGame at any time. We may suspend or terminate access, remove content, pause generations, or limit publishing if we believe you violated these Terms, created legal or security risk, failed to pay, abused credits, or used ShortGame in a way that could harm users, third parties, or the Service.
Disclaimers
ShortGame is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation. We do not guarantee that generated games will be bug-free, original, secure, legally compliant, profitable, suitable for children, or accepted by any platform or store.
Limitation of liability
To the maximum extent permitted by law, ShortGame will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost goodwill, business interruption, or costs of substitute services. Our total liability for claims relating to the Service is limited to the amount you paid to ShortGame for the Service in the three months before the event giving rise to the claim, or USD $100 if you paid nothing.
Indemnity
You will defend, indemnify, and hold harmless ShortGame and its service providers from claims, damages, losses, liabilities, costs, and expenses arising from your content, generated games, published games, use of the Service, violation of these Terms, or violation of third-party rights or law.
Changes to these Terms
We may update these Terms as ShortGame changes. If an update materially affects your rights or obligations, we will provide notice where required. Your continued use of ShortGame after an update means you accept the updated Terms.
