ShortApp Terms of Service

1. Acceptance of Terms
Welcome to ShortApp. By accessing or using the ShortApp website, platform, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms are a legally binding agreement between you ("User", "you", or "your") and ShortApp ("ShortApp", "we", "us", or "our").
2. Description of Services
ShortApp provides an AI-powered platform that allows users to generate mobile application code (specifically based on the Expo framework) using natural language prompts ("Vibe Coding"). The Services may also enable connections to external databases and third-party APIs.You acknowledge that ShortApp is a tool for code generation. We do not actively monitor, endorse, or assume responsibility for the applications you build, compile, distribute, or operate using our Services.
3. User Accounts and Eligibility
3.1 Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You are fully responsible for all activities that occur under your account, regardless of whether you authorized them.
4. User Content and Generated Output
4.1 User Content
You retain ownership of all text prompts, data configurations, database credentials, API keys, and other materials you submit to the Services ("User Content"). You grant ShortApp a worldwide, non-exclusive, royalty-free license to use, host, store, and process your User Content strictly for the purpose of providing and improving the Services (including debugging and, if applicable, training our AI models, subject to your privacy settings).
4.2 Generated Output
Subject to your compliance with these Terms, you own the rights to the software code and application structure generated by ShortApp based on your User Content ("Output").
4.3 Responsibility for Content and Output
You are solely responsible for your User Content and any Output you generate. You represent and warrant that you have all necessary rights to use any data, APIs, or content you incorporate into your applications and that your use of the Services will not infringe upon any third-party rights.
5. Acceptable Use Policy (AUP)
You agree NOT to use ShortApp to create, generate, host, or distribute any application or code that:
- Violates Laws:Facilitates or promotes illegal activities, including but not limited to fraud, money laundering, or regulated activities without proper licensure.
- Infringes Rights:Infringes upon the intellectual property, privacy, or publicity rights of others.
- Harmful Content:Contains or promotes hate speech, harassment, violence, discrimination, explicit sexual content, or self-harm.
- Malicious Code:Contains viruses, malware, spyware, phishing scams, or any code designed to disrupt, damage, or gain unauthorized access to third-party systems.
- Spam:Generates unsolicited bulk communications.
We reserve the right, but have no obligation, to investigate your use of the Services and to suspend or terminate your access if we believe you have violated this AUP.
6. AI Disclaimer and No Reliability
The Services utilize Large Language Models (LLMs) and other AI technologies, which may be unpredictable.
- Accuracy: Output may contain errors, bugs, or security vulnerabilities. You are solely responsible for reviewing, testing, and debugging any code generated by ShortApp before deployment or distribution.
- No Warranty: WE DO NOT GUARANTEE THAT THE GENERATED CODE WILL BE FUNCTIONAL, SECURE, OR SUITABLE FOR ANY SPECIFIC PURPOSE.
7. Distribution of Generated Apps & Third-Party Platforms
7.1 Independent Distribution
You may choose to compile and distribute your Output (e.g., as an .ipa or .apk file) through third-party platforms such as the Apple App Store, Google Play Store, or Expo Go (collectively, "App Stores").
7.2 No Responsibility for Published Apps
YOU ACKNOWLEDGE AND AGREE THAT SHORTAPP HAS NO CONTROL OVER APPLICATIONS ONCE THEY ARE EXPORTED FROM OUR PLATFORM OR SUBMITTED TO APP STORES.We do not operate, manage, or have the ability to delete, modify, or "take down" applications that you have successfully published on third-party App Stores. Your relationship regarding those published applications is solely between you and the respective App Store.
7.3 Compliance with App Store Policies
You are solely responsible for ensuring your applications comply with all applicable App Store review guidelines, developer agreements, and local laws.
8. Cooperation with Law Enforcement
While we do not proactively monitor user applications, ShortApp cooperates fully with law enforcement and government authorities.
- Disclosure:We may disclose your User Content, account information, and usage logs to law enforcement if required by a valid legal process (e.g., subpoena, court order, or search warrant) or to protect the safety of any person.
- Service Termination:Upon receipt of a valid order from a competent authority, we will immediately suspend or terminate your access to the Services and prevent further generation or management of your applications through our platform. HOWEVER, AS STATED IN SECTION 7.2, WE CANNOT EFFECTUATE THE REMOVAL OF APPS ALREADY DISTRIBUTED ON THIRD-PARTY APP STORES.
9. Third-Party Services and External Data
Our Services may allow you to connect to external databases (e.g., PostgreSQL, MongoDB) and third-party data APIs.
- You are solely responsible for securing the appropriate rights and permissions to access and use such third-party services.
- ShortApp assumes no responsibility for the availability, accuracy, security, or legality of any data accessed via these external connections.
- You are responsible for securing any API keys or database credentials you use within ShortApp.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHORTAPP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WE EXPRESSLY DISCLAIM ANY LIABILITY FOR THE ACTIONS OF USERS OF YOUR GENERATED APPLICATIONS. YOU ARE SOLELY RESPONSIBLE FOR ANY HARM CAUSED BY APPLICATIONS YOU CREATE USING OUR SERVICES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHORTAPP, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY GENERATED OUTPUT OR USER CONTENT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL SHORTAPP'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID SHORTAPP, IF ANY, IN THE LAST TWELVE (12) MONTHS.
12. Indemnification
You agree to defend, indemnify, and hold harmless ShortApp and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that an application you generated caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.
13. Cancellation, Refunds, and Termination
You may cancel your ShortApp subscription at any time through the account settings within the Services or by contacting us at [email protected]. Cancellations take effect at the end of the then-current billing period, and you will continue to have access to paid features until that billing period expires. We will not charge you for any subsequent billing periods after the cancellation becomes effective.
All fees and charges are non-refundable, and we do not issue credits or refunds for partial billing periods, downgrades, or unused Services.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or the AUP. Upon termination, your right to use the Services will immediately cease.
14. General Terms
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Insert Your Jurisdiction, e.g., State of Delaware, United States], without regard to its conflict of law provisions.
- Changes to Terms: We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
